Following the recent condemnation of the National Health Service charging regulations by medical colleges and the UK Faculty of Public Health, we demonstrate that through enactment of this policy, the medical profession is betraying its core ethical principles. Through dissection of the policy using Beauchamp and Childress’ framework, a disrespect for autonomy becomes evident in the operationalisation of the charging regulations, just as a disregard for confidentiality was apparent in the data sharing Memorandum of Understanding. Negative consequences of the regulations (...) are documented to highlight their importance for clinical decision makers under the principles of beneficence and non-maleficence. Exploration of the principle of justice illuminates the core differentiation between the border-bound duties of the State and borderless duties of the clinician, exposing a fundamental tension. Internal auditors' code of ethics is found to have a strong moral approach, contrasting to the more instrumental approach of certified professional accountants. In this article, I explore the auditory technopolitics of prenatal sound systems, asking what kinds of futures, listeners and temporalities they seek to produce. With patents for prenatal audio apparatus dating back to the late 1980s, there are now a range of devices available to expectant parents. These sound technologies offer multiple benefits: from soothing away stress to increasing the efficiency of ultrasonic scans. However, one common point of emphasis is their capacity to accelerate foetal ‘learning’ and cognitive development. Taking (...) as exemplary the Babypod and BabyPlus devices, I argue that prenatal sound systems make audible a particular figuration of pregnancy and gestational labour that combines divergent notions of responsibility and passivity. Contra the equation of neoliberalism with self-control and individualism, I argue that prenatal sound systems amplify neoliberal capitalism’s elision of personal, maternal and familial responsibility. As reproductive sound technologies, prenatal sound systems facilitate maternal–familial investment in the pre-born as future-child. Consequently, financialised notions of inheritance are substituted for biological inheritance. Drawing attention to the common rhetorical figuration of the sonic as womb-like, furthermore, I argue that prenatal sound systems exemplify what I refer to as uterine audiophilia. By treating the womb as ‘the perfect classroom’, prenatal sound systems imply an intense maternal obligation to invest in and impress upon the future-child, while also envisioning the pregnant person’s body as an occupied, resonant space. Cohering with a fidelity discourse that posits the reproductive medium as passive container and a source of noise that is to be overcome, uterine audiophilia relies upon politically regressive conceptualisations of pregnancy. I thus argue that these devices mark the hitherto under-theorised convergence of auditory culture, technology and reproductive politics. (shrink)

Our primary focus is on analysis of the concept of voluntariness, with a secondary focus on the implications of our analysis for the concept and the requirements of voluntary informed consent. We propose that two necessary and jointly sufficient conditions must be satisfied for an action to be voluntary: intentionality, and substantial freedom from controlling influences. We reject authenticity as a necessary condition of voluntary action, and we note that constraining situations may or may not undermine voluntariness, depending on the (...) circumstances and the psychological capacities of agents. We compare and evaluate several accounts of voluntariness and argue that our view, unlike other treatments in bioethics, is not a value-laden theory. We also discuss the empirical assessment of individuals? perceptions of the degrees of noncontrol and self-control. We propose use of a particular Decision Making Control Instrument. Empirical research using this instrument can provide data that will help establish appropriate policies and procedures for obtaining voluntary consent to research. (shrink)

Experiential evidence shows that pain is associated with common meanings. These include a meaning of threat or danger, which is experienced as immediately distressing or unpleasant; cognitive meanings, which are focused on the long-term consequences of having chronic pain; and existential meanings such as hopelessness, which are more about the person with chronic pain than the pain itself. This interdisciplinary book - the second in the three-volume Meanings of Pain series edited by Dr Simon van Rysewyk - aims to better (...) understand pain by describing experiences of pain and the meanings these experiences hold for the people living through them. The lived experiences of pain described here involve various types of chronic pain, including spinal pain, labour pain, rheumatic pain, diabetic peripheral neuropathic pain, fibromyalgia, complex regional pain syndrome, endometriosis-associated pain, and cancer-related pain. Two chapters provide narrative descriptions of pain, recounted and interpreted by people with pain. Language is important to understanding the meaning of pain since it is the primary tool human beings use to manipulate meaning. As discussed in the book, linguistic meaning may hold clues to understanding some pain-related experiences, including the stigmatisation of people with pain, the dynamics of patient-clinician communication, and other issues, such as relationships between pain, public policy and the law, and attempts to develop a taxonomy of pain that is meaningful for patients. Adaptive preferences have been extensively studied in decision theory and feminist political theory, but not in experimental philosophy. In feminist contexts, the term is used to discuss cases in which women seem to accept abusive treatment and other conditions of oppression. According to one class of theories, women who accept abusive behavior are cognitively deficient: irrational, lacking autonomy, or not acting in accordance with their identity. Other theories deny this, saying that under certain conditions, accepting abuse can be a sound (...) response, given available alternatives. We survey lay opinions about a case in which a woman endures domestic violence and find that people often attribute adaptive attitudes and tend to see them as rational, free, and reflective of identity. We also examine lay normative judgments, including options about the right course of action, and the locus of blame, finding, for example, some tendency to blame the victim in such cases. Such attitudes are impacts by gender and political orientation. We also manipulated the cultural setting of our vignette, but found no impact. (shrink)

Diverse legal and regulatory measures are used internationally to control the information provided during pharmaceutical sales visits. Little is known about the comparative effectiveness of these measures however. We analyzed the perceptions of regulators, pharmaceutical industry officials, health professionals, and consumer respondents concerning these approaches in Canada, France, and the United States using an empirical realist interests-based approach. Interviews focused on the aims and effectiveness of regulation, barriers and enablers to regulation and suggestions for improvement. An alignment was found in (...) North America regulator and industry respondents' satisfaction with the status quo and their view that further intervention is unfeasible and unnecessary. Health professionals generally expressed a lack of confidence in the impact of regulations on sales visit information while consumer advocates voiced their disappointment in both regulators and health professionals for their failure to counteract the influence of pharmaceutical marketing. Regulator and industry respondents in France differed from their North American counterparts in their willingness to increase and diversify the scope of regulatory interventions. As the first international comparison of regulatory experiences in this sector, the findings highlight the universal need for more focused and inclusive discussions among groups about how to tailor regulations to achieve public health goals. The extant clinical literature indicates profound problems in the assessment, monitoring, and documentation of care in long-term care facilities. The lack of adequate resources to accommodate higher staff-to-resident ratios adds additional urgency to the goal of identifying more costeffective mechanisms to provide care oversight. The ever expanding array of electronic monitoring technologies in the clinical research arena demands a conceptual and pragmatic framework for the resolution of ethical tensions inherent in the use of such innovative tools. CareMedia is a project (...) that explores the utility of video, audio and sensor technologies as a continuous real-time assessment and outcomes measurement tool. In this paper, the authors describe the seminal ethical challenges encountered during the implementation phase of this project, namely privacy and confidentiality protection, and the strategies employed to resolve the ethical tensions by applying principles of the interest theory of rights. This paper reports a literature review on the topic of ethical issues in in-depth interviews. The review returned three types of article: general discussion, issues in particular studies, and studies of interview-based research ethics. Whilst many of the issues discussed in these articles are generic to research ethics, such as confidentiality, they often had particular manifestations in this type of research. For example, privacy was a significant problem as interviews sometimes probe unexpected areas. For similar reasons, it is difficult to (...) give full information of the nature of a particular interview at the outset, hence informed consent is problematic. Where a pair is interviewed (such as carer and cared-for) there are major difficulties in maintaining confidentiality and protecting privacy. The potential for interviews to harm participants emotionally is noted in some papers, although this is often set against potential therapeutic benefit. As well as these generic issues, there are some ethical issues fairly specific to in-depth interviews. The problem of dual role is noted in many papers. It can take many forms: an interviewer might be nurse and researcher, scientist and counsellor, or reporter and evangelist. There are other specific issues such as taking sides in an interview, and protecting vulnerable groups. Little specific study of the ethics of in-depth interviews has taken place. However, that which has shows some important findings. For example, one study shows participants are not averse to discussing painful issues provided they feel the study is worthwhile. Some papers make recommendations for researchers. One such is that they should consider using a model of continuous (or process) consent rather than viewing consent as occurring once, at signature, prior to the interview. However, there is a need for further study of this area, both philosophical and empirical. (shrink)

In this paper I explore a series of fertile ambiguities that Merleau-Ponty’s work is premised upon. These ambiguities concern some of the central methodological commitments of his work, in particular his commitment to transcendental phenomenology and how he transforms that tradition, and his relationship to science and philosophical naturalism and what they suggest about his philosophical methodology. Many engagements with Merleau-Ponty’s work that are more ‘analytic’ in orientation either deflate it of its transcendental heritage, or offer a “modest” rendering of (...) its transcendental dimensions. This is also true, albeit perhaps to a lesser extent, of the work of the more empirically-minded phenomenological philosophers who engage very seriously with Merleau-Ponty—e.g. Hubert Dreyfus, Shaun Gallagher, Evan Thompson, Alva Noë, and others. At the same time, many other scholars contest these proto-scientific and more naturalistic uses of Merleau-Ponty’s work on hermeneutical and exegetical grounds, and they likewise criticise the deflated reading of his transcendental phenomenology that tends to support them. By working through some of the key passages and ideas, this paper establishes that the former view captures something pivotal to Merleau-Ponty’s philosophy. I also extend these interpretations by arguing that, at least around the time of Phenomenology of Perception, his philosophy might be reasonably regarded as a form of minimal methodological naturalism. Born with a rare genetic disease, severe combined immune deficiency (SCID), Ashanti lacked a healthy immune system and was extremely vulnerable to infection. Children with SCID usually develop overwhelming infections and rarely survive to adulthood; even a (...) common childhood illness like chicken pox is life-threatening. Ashanti led a cloistered existence, avoiding contact with people outside her family, remaining in the sterile environment of her home, and battling frequent illnesses with massive amounts of antibiotics.In Ashanti's gene therapy procedure, her own white blood cells were genetically modified and then infused back into her bloodstream. Laboratory tests show that the therapy has strengthened Ashanti's immune system. She no longer has recurrent colds, has been allowed to attend school, and has been immunized against whooping cough. This gene therapy procedure is not a cure, however. The genetically-treated white blood cells only survive for a few months and must then be replaced, but Ashanti's future is much brighter because of the new therapy (VI, Thompson [The First] 1993).Although this simplified description of Ashanti's gene therapy procedure sounds like a happy ending, it is little more than an optimistic chapter in a long story. The road to the first approved gene therapy procedure was rocky and fraught with controversy. The biology of human gene therapy is very complex, and there are still many techniques that need to be developed and diseases that need to be understood more fully before gene therapy is well established. The public policy debate surrounding the possible use of genetically engineered material in human subjects is equally complex. Major participants in the debate come from the fields of biology, government, law, medicine, philosophy, politics, and religion, each bringing different views to the discussion.In studying the ethics of gene therapy, one should draw a distinction between [End Page 63] therapy on somatic (non-reproductive) cells and germ (reproductive) cells. Only the germ cells carry the genes that will be passed on to the next generation. Reactions to gene therapy have varied widely. Some commentators on gene therapy object to any form of genetic manipulation, no matter how well-intentioned (VI, Rifkin 1983). Another reaction is to allow the use of somatic-cell therapy, but not to approve the use of germ-line therapy, which could have unforeseeable effects on future generations. A different stance is that, with proper regulation and safeguards, germ-line gene therapy is a logical extension of the progress made to date and that it is an ethically acceptable procedure.TechniquesTo date, 43 research protocols have been approved for somatic-cell gene therapy in the United States. The techniques employed in each protocol vary, but in general a virus is used as a "vector" to insert the desired gene into the DNA of the patient's cells, in order to compensate for a defective gene. For Ashanti's gene therapy, this technique involved obtaining white blood cells and introducing properly functioning genes into as many of the cells as possible. There are two basic ways to perform germ-line gene therapy: (1) to treat a preimplantation embryo that carries a serious genetic defect before its implantation in the mother, which necessitates the use of in vitro fertilization techniques; or (2) to treat the germ cells (sperm or egg cells) of afflicted adults so that the genetic defects would not be passed on to their offspring, which requires the technical expertise to delete the defective gene and insert a properly functioning replacement. In his article, ‘Social constructionism and climate science denial’, Hansson claims to present empirical evidence that the cultural theory developed by Dame Mary Douglas, Aaron Wildavsky and ourselves leads to science denial. In this reply, we show that there is no validity to these claims. First, we show that Hansson’s empirical evidence that cultural theory has led to climate science denial falls apart under closer inspection. Contrary to Hansson’s claims, cultural theory has made significant contributions to understanding and addressing (...) climate change. Second, we discuss various features of Douglas’ cultural theory that differentiate it from other constructivist approaches and make it compatible with the scientific method. ABSTRACTWe trace Susan Moller Okin’s reception of Mary Wollstonecraft with respect to the relationship between religion and feminist liberalism, by way of manuscripts housed at Somerville College, Oxford and Harvard University. These unpublished documents – dated from 1967 to 1998 – include her Somerville advising file, with papers dated from 1967 to 1979; her 1970 Oxford B.Phil. thesis on the feminist political theory of Wollstonecraft, William Thompson, and J.S. Mill; her teaching notes on Wollstonecraft originating in 1978, for (...) her course ‘Gender and Political Theory’ held at Brandeis and Stanford in the 1980s and 1990s; and her correspondence with John Rawls, dated from 1985 to 1998. A consistently secular feminist liberal, Okin had a blind spot with regard to religion, which led her to misinterpret Wollstonecraft’s theology as contradictory to her consequentialist arguments for women’s rights. Wollstonecraft virtually disappeared from Okin’s published corpus, overshadowed by the secular utilitarian feminist liberal J.S. Mill. Wollstonecraft nevertheless remained a deep philosophical source for both the method and the principle behind Okin’s distinctive brand of feminist liberalism. Okin’s reception of Wollstonecraft suggests that the fissures caused by religious conflict in modern politics have not only generated multiple liberalisms, as Rawls argued, but also multiple feminist liberalisms. The ostensible purpose of the symposium was to consider the double nature and status of rhetoric: on one hand, a hermeneutic/theoretical discipline with applications across the humanities (in the analysis of texts, events, culture, argumentative practices, ideologies, and so forth); and, on the other hand, a practical "art of discourse," a techne, whose central or distinctive application is the training of skilled writers and speakers. The former tends to be emphasized in contemporary rhetorical studies, while the latter is the most familiar (though not necessarily essential) characteristic of "classical" or ancient rhetoric. Likewise, we can connect these two orientations, respectively, with rhetorical cultural studies and with the teaching of writing, speaking, and communication in general. While the natural assumption is that these two orientations are mutually supporting, that is not always or necessarily the case. One can argue that the first pulls in the direction of "philosophy" (however that may be defined), while the second pulls in the direction of sheer technique—and at one time or another, each has been [End Page 91] open to criticism for its lack of attention to the other: philosophers are ineffective rhetoricians, and cannot intervene in the public sphere; orators are superficial thinkers, and practice an irresponsible, demagogic art of manipulation and domination. This tension goes all the way back to the first critiques of the sophists, and plays out through the entire history of rhetoric. The symposium's speakers, then, were asked to reflect, in any way that seemed suitable to them, on either or both aspects of rhetoric's double nature, and/or the relationships between them.A symposium, inevitably, as a rhetorical event, always takes its own somewhat unpredictable trajectory, as papers are produced and presented, and as the ensuing discussion unfolds. And the four essays presented here—Steven Mailloux on Frederick Douglass and the nineteenth-century American debate over slavery; Susan Wells on "double consciousness" in S. Weir Mitchell's account of the case of Mary Reynolds and W. E. B. Du Bois's The Souls of Black Folk; James L. Weir Mitchell and W.E.B. Du Bois 1 Susan Wells Here are two stories about double consciousness: they will become, eventually, stories about the public sphere: W. E. B. Du Bois formulating the theory of double consciousness, and S. Weir Mitchell presenting Mary Reynolds's case history, an instance of a mental (...) disorder known in the nineteenth century as double consciousness. I will begin with Du Bois's story, by far the most familiar to us: few texts are more central to contemporary rhetoric or cultural studies than the discussion of double consciousness in the opening pages of The Souls of Black Folk. 2 In the theory of double consciousness, Du Bois concentrated his contradictory experiences of scholarship, activism, social isolation, and active cosmopolitanism. Double consciousness was a methodological constraint that enabled Du Bois to build into the structure of The Souls of Black Folk a recognition that the complexity of African American life requires more than one perspective. And double consciousness was also a technique of writing, shaping the ironic and urgent voice of the book, by turns indignant and tender, eloquent and colloquial, a form of double address to both African American and Caucasian readers that allowed Du Bois to be two places at once. Double consciousness therefore controlled both the development and the presentation of The Souls of Black Folk, from the arc of its argument to its formal elements, includingDu Bois's famous use of chapter epigraphs to link canonic poetry with the melodies of the sorrow songs. Like the most relentlessly formal high modernist poem, the book continually enacts in its form not only its informing idea, but the circumstances of its composition and the constraints that shape its reading.The book's initial essay, "Of Our Spiritual Strivings," offers an analysis of double consciousness as it is shaped by three central categories of modernity: temporality, embodiment, and expertise. Double consciousness is located in time, in history; it is placed in a story of the epochal succession [End Page 120] of races, and in the specific history of slavery. Double consciousness emerges as strategically shaping African American responses to the problems of disenfranchisement, poverty, and the denial of civil rights after the suppression of Reconstruction. The historical sections of The Souls of Black Folk, therefore, do not simply rectify the facts, setting the record straight on Reconstruction or Afrocentric scholar and theorist Alexander Crumell. These local arguments all motivate an understanding of consciousness as temporally constituted, so that the work of previous generations can be effective only when it is appropriated in the present. Such appropriation is supported and mediated by the form of the book: Du Bois ends with an invocation to "God the Reader," who alone can ensure that "these crooked marks on a fragile leaf be not indeed THE END" (19).Double consciousness is also connected with embodiment, specifically the embodiment of African Americans, externalized and displaced in two images: blood, which I will discuss later in the essay, and the veil or caul that grants second sight. Like skin color, the caul is an inconsequential physical object invested with enormous symbolic power (8); it is a mark of origins that foretells the future. The "second sight" offered to the Negro is a vision of "two warring ideals," a vision that can barely be supported by "one dark body, whose dogged strength alone keeps it from being torn asunder"(9). At moments in The Souls of Black Folk, the veil is generalized, and becomes a physical barrier between the white world and the world of African American culture; the work of separating these worlds, of rendering them invisible to one another, is staged on the bodies of African Americans. This chapter first distinguishes between originality and creativity. True originality is rare, whether in art, science, or LEGO, because to be truly original means to have done something that no one has ever done before, and that no one could have anticipated. Most LEGO creations will not meet that condition, for with the exception of serious hobbyists who undertake massive builds, most players who make original creations are making creations that are commonplace. Painting or remolding or placing stickers on the (...) bricks counts against the spirit of LEGO creation. The chapter then discusses The LEGO Movie embodies the paradox that presents three conflicting models of creative LEGO play, illustrated by the Master Builders, Finn's father, and Emmet. The movie's creators were deliberately playing around with conflicting popular conceptions of creativity: creativity as madness, creativity as thinking outside the box, and creativity as vision. The #metoo movement has forced many fans to consider what they should do when they learn that a beloved artist has acted immorally. One natural thought is that fans ought to give up the artworks of immoral artists. In Why It's OK to Enjoy the Work of Immoral Artists, Mary Beth Willard argues for a more nuanced view. Enjoying art is part of a well-lived life, so we need good reasons to give it up. And it turns out good (...) reasons are hard to find. Willard show that it's reasonable to believe that most boycotts of artists won't succeed, so most of the time there's no ethical reason to join in. Someone who manages to separate the art from the artist isn't making an ethical mistake by buying and enjoying their art. She then considers the ethical dimensions of canceling artists and so-called "cancel culture," arguing that canceling is ethically risky because it encourages moral grandstanding. Willard concludes by arguing that the popular debate has overlooked the power of art to change our lives for the good. It's of course OK to decide to give up the artwork of immoral artists, but--as Willard shows in this provocative little volume--it's OK to continue to enjoy their art, as well. In this article, I respond to queer critiques of the pursuit of same-sex marriage. I first examine the issue of normalization through a consideration of the everyday lives of same-sex couples with children, a subject about which queer critics are strangely silent. Children force same-sex couples to be out in multiple areas of their lives and recent court cases explicitly challenge the idea that same-sex couples do not make fit parents. Second, I examine whether same-sex marriage will address structural inequalities (...) or will mainly benefit white, middle-class people. Access to marriage has disparate benefits depending on people’s structural locations, but is a movement goal supported by a broad array of LGBT people. Third, I examine the relationship between marriage, regulation, and the state. I argue for a broader understanding of the relationship between the state and different types of relationships, suggesting that it is impossible to escape regulation. If we consider marriage and family forms cross-nationally, we see a variety of possibilities for state recognition of various family forms. I conclude by assessing the impact of same-sex marriage on the future of LGBT politics, arguing that achieving marriage equality may allow the space for new political possibilities to emerge.
